These Terms of Service ("Terms") govern your access to and use of meritsciences.com and the products and services we offer through it (the "Services"). The Services are operated by Merit Sciences ("Merit Sciences," "we," "us," or "our"). By placing an order, creating an account, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
These Terms contain important provisions about how disputes between you and Merit Sciences are resolved, including a Texas governing-law clause and a limitation of liability. Read them carefully.
1. Research-only products. Not for human or veterinary use.
The peptides, amino acids, and related compounds we sell ("Compounds") are sold strictly as research chemicals for in vitro laboratory and scientific research use only. Compounds are NOT drugs, NOT dietary supplements, NOT cosmetics, NOT medical devices, and NOT intended for use in or on humans or animals. They have not been approved by the U.S. Food and Drug Administration for therapeutic, diagnostic, or any other in vivo use.
By placing an order, you represent and warrant that:
- You are at least 21 years of age and have full legal capacity to enter into these Terms.
- You are a qualified researcher, laboratory professional, or licensed practitioner ordering for a legitimate research purpose.
- You will not administer, ingest, inject, apply, or otherwise introduce any Compound into a human or animal body.
- You will handle, store, and dispose of Compounds in accordance with applicable laws, institutional safety policies, and accepted laboratory practice.
- You will not resell, redistribute, or transfer Compounds to any party who does not also meet these representations.
You assume all risk and responsibility associated with your handling and use of Compounds. Merit Sciences disclaims any responsibility for misuse.
2. Eligibility and account access
You may browse the Services without an account. To place an order you must provide accurate contact, shipping, and payment information. Practitioner pricing is available only to verified licensed healthcare professionals through our Practitioner Program; approval is at our discretion and is not guaranteed.
If you create an account or sign in to the Practitioner Portal, you are responsible for safeguarding your account email and any sign-in links delivered to it. You must notify us immediately if you suspect unauthorized access.
3. Orders, pricing, and payment
When you submit an order, you are making an offer to purchase. We may accept, decline, or limit any order at our discretion, including for reasons related to product availability, suspected fraud, regulatory concerns, shipping destination, or violation of these Terms. Your order is accepted only when we send an order confirmation email; an authorization on your card or PayPal account does not, by itself, constitute acceptance.
Prices are listed in U.S. dollars and are subject to change without notice. The price charged is the price displayed at the time the order is submitted. Practitioner-tier pricing applies only to active, approved Practitioner accounts and only while signed in. Posted prices do not include shipping (unless noted), handling, or applicable taxes.
We accept payment through PayPal, including PayPal balance, debit card, and credit card routed through the PayPal checkout. We do not store full payment-card numbers; payment information is handled by PayPal under their terms.
If a price posted on the Services is materially incorrect due to a system error, we reserve the right to cancel the affected order and refund any amount charged.
4. Shipping, title, and risk of loss
We ship within the United States only. Estimated dispatch and delivery timelines, including any free-shipping threshold, are described in our Shipping Policy, which forms part of these Terms.
Title and risk of loss pass to you when we hand the package to the carrier. We are not liable for carrier delays, weather events, address errors you provided, or theft after delivery. If a package is lost or arrives damaged, contact us within 7 days of the expected delivery date so we can work with the carrier on a claim or replacement, as described in our Returns Policy.
5. Returns and refunds
Because Compounds are sterile, sealed, single-use research products with no chain-of-custody once they leave our facility, returns are accepted only in limited circumstances. The full policy, including how to request a replacement for a damaged or incorrect shipment, is in our Returns Policy, which is incorporated into these Terms by reference.
6. Acceptable use
You agree not to, and not to permit anyone else to:
- Use the Services in any way that violates federal, state, or local law, including any applicable controlled-substance, customs, or export-control law.
- Resell Compounds to consumers or represent them as therapeutic products, supplements, or cosmetics.
- Submit false, misleading, or fraudulent information during checkout or in a Practitioner application.
- Attempt to interfere with, probe, scan, or test the vulnerability of any part of the Services, or bypass authentication or rate-limiting mechanisms.
- Scrape, harvest, or systematically download content from the Services for commercial purposes.
- Misrepresent your affiliation with Merit Sciences or use our trademarks without written permission.
7. Intellectual property
The Services and all content on them — including the Merit Sciences name and logo, the merit-policy and merit-render design systems, photography, product pages, research summaries, and email templates — are owned by Merit Sciences or our licensors and are protected by U.S. and international intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. All other rights are reserved.
References to scientific literature on product pages are provided for informational purposes and remain the intellectual property of their respective authors and publishers.
8. Practitioner Program
The Practitioner Program is offered to verified licensed U.S. healthcare professionals. Acceptance is at our discretion and may be revoked at any time, with or without cause, if we determine an account is misused, if licensure status changes, or if your account violates these Terms. Practitioner pricing is confidential — you may not publicly post, share, or screenshot Practitioner-tier prices, and you may not use Practitioner pricing to purchase Compounds for resale to consumers.
9. Email and SMS communications
By placing an order or creating an account, you consent to receive transactional emails relating to your order, account, and security (order confirmations, shipping updates, delivery notifications, sign-in links, refund notices, and similar). You may separately opt in to marketing email, which you can unsubscribe from at any time through the link in any marketing message.
10. Disclaimers
THE SERVICES AND ALL COMPOUNDS, MATERIALS, AND INFORMATION PROVIDED THROUGH THEM ARE OFFERED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
NOTHING ON THE SERVICES IS MEDICAL ADVICE. PRODUCT DESCRIPTIONS, RESEARCH SUMMARIES, AND CITATIONS ARE PROVIDED FOR INFORMATIONAL AND RESEARCH PURPOSES ONLY. WE MAKE NO REPRESENTATION THAT ANY COMPOUND IS SAFE OR EFFECTIVE FOR HUMAN OR ANIMAL USE, AND WE DO NOT INTEND ANY STATEMENT ON THE SERVICES TO BE INTERPRETED AS A THERAPEUTIC CLAIM.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MERIT SCIENCES OR ITS OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY) ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR ANY COMPOUND, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR ANY COMPOUND IS LIMITED TO THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to defend, indemnify, and hold harmless Merit Sciences and our officers, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of any Compound, including administration to a human or animal, (c) your violation of any law or third-party right, or (d) any false representation you made when ordering or applying for a Practitioner account.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you and Merit Sciences consent to the personal jurisdiction of those courts.
You agree that any claim must be brought within one year after the cause of action arose, or it is permanently barred.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we update the "Last updated" date at the top of the page. Material changes will be communicated by email or a prominent notice on the Services before they take effect. Continued use of the Services after a change constitutes acceptance of the revised Terms.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of our business. These Terms, together with our Privacy, Shipping, and Returns policies, constitute the entire agreement between you and Merit Sciences regarding the Services.
